This document has three parts: 1. Terms of Service, 2. Privacy Policy, 3. Refund Policy.

1. Terms of Service

1.1. Acceptance

By using NFT Prompt Builder (the "Service", "we"), you accept these Terms. If you disagree, do not use the Service. The Service is provided by the w3ir.io project team (legal entity registration in progress).

1.2. What the Service is

The Service is a tool to create mint-ready content: generating text prompts, images (via third-party AI providers) and metadata (ERC-721 / Metaplex), and exporting mint-ready bundles. The Service does not mint NFTs in-app, is not an exchange/marketplace, does not custody your assets, and does not control your keys. You mint elsewhere yourself.

1.3. Eligibility

You must be 18+ with legal capacity to contract. You are not located in a sanctioned jurisdiction and you comply with your local laws. You are solely responsible for compliance with the laws of your country regarding generative content, crypto-assets and NFTs.

1.4. Access and wallet

Sign-in is by wallet signature (SIWE; EVM or Solana). We never store or access your private keys. You are responsible for your wallet's security and for all activity under it.

1.5. Credits and payment

• Credits are internal units to cover AI API costs. They are not legal tender, have no

monetary value outside the Service, and are non-transferable and non-exchangeable for cash.

• Top-ups are via Helio Pay (USDC on Base); packages are shown under 💳 Credits.
• New wallets may receive welcome credits (anti-Sybil balance check). Credits are **consumed per

generation**; cost depends on the engine.

• Refund details are in part 3.

1.6. Acceptable use

You must not create or attempt to create unlawful content, including (without limitation):

• sexualization of minors (CSAM) and sexual violence — such prompts are automatically blocked

by moderation;

• content infringing others' intellectual property, trademarks or likeness rights;
• deception, impersonation, fraud, malware.

We may filter/reject prompts, apply daily limits, and suspend access for abuse. You are responsible for all content you create through the Service.

1.7. Intellectual property

• Generated content: rights to AI output are governed by the respective providers' terms (OpenAI,

Anthropic, Stability, Replicate, etc.). To the extent of our rights, you may use the assets you create. You are solely responsible for ensuring your prompts and outputs do not infringe third- party rights, and for the legality of minting/selling them.

• Attribution: a bundle may include a "Made with w3ir" mark (disabled on certain tiers).
• Our software and brand (code, UI, name, logo) remain our property.

1.8. AI disclaimer

Generative model output is probabilistic: it may be inaccurate, offensive, similar to existing works, or non-unique. We do not guarantee uniqueness, quality or fitness for a particular purpose. Review the output before minting.

1.9. No financial/legal advice

Nothing in the Service is investment, legal or tax advice. NFTs are high-risk; we **do not guarantee any value** of created assets.

1.10. Third-party services

The Service relies on third parties (OpenAI, Anthropic, Stability, Replicate, Pinata/IPFS, Helio, Cloudflare, blockchain RPC nodes). Their operation is governed by their terms; we are not liable for their outages, price changes or availability.

1.11. Disclaimer of warranties and limitation of liability

The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or incidental damages; total liability is capped at the amount you paid for the Service in the preceding 3 months. You will indemnify us for losses arising from your breach of these Terms.

1.12. Suspension and termination

We may suspend or terminate access for breach or abuse. You may stop using the Service at any time.

1.13. Changes and governing law

We may update these Terms; material changes are marked with a new "Effective" date. Governing law is specified upon incorporation; until then, disputes are resolved through good-faith negotiation. Questions — [email protected].

2. Privacy Policy

2.1. Who we are

2.2. Data we process

• Wallet address (public) — identifier for credits and history.
• On-chain balance reads (native balance for anti-Sybil) via RPC nodes.
• Generation data — your prompts, generated images, metadata, history — stored **on our server,

isolated per wallet**.

• Payment data — transaction ID, amount (via Helio; crypto only, we never see bank/card data).
• Session cookie w3ir_session (HMAC) — for sign-in.
• Server logs (IP, basic) — for security and rate-limiting; aggregate Cloudflare analytics.
• We do NOT collect email, name or other traditional personal data; there is no account beyond

the wallet.

2.3. Why

To provide the Service, account for credits, prevent abuse/Sybil, and improve the product.

2.4. Who we share with

• AI providers (OpenAI, Anthropic, Stability, Replicate) — your prompts/images for generation.
• Pinata/IPFS — files if you publish to IPFS (content becomes public and immutable).
• Helio — to process payments. Cloudflare — for delivery/protection.
• Each party has its own policy. We do not sell your data.

2.5. Retention

History is kept until you request deletion or while the wallet is active; logs are rotated. On-chain and payment transactions are immutable on the blockchain — outside our control.

2.6. Security

HMAC sessions, secrets kept out of code, database backups. No system is perfectly secure.

2.7. Your rights

You may request deletion of your wallet's stored data — email [email protected]. On-chain data cannot be deleted.

2.8. Cookies

Only an essential session cookie; Cloudflare may set technical/security cookies.

2.9. Children

The Service is not intended for anyone under 18.

2.10. Changes

Updates are marked with the "Effective" date. Questions — [email protected].

3. Refund Policy

3.1. Nature of payments

Payment is by cryptocurrency (USDC on Base); such transfers are technically irreversible. Credits are digital, consumable units.

3.2. Non-refundable

• Consumed credits (spent on generations) are non-refundable.
• Welcome, referral and granted credits — promotional, with no cash value.

3.3. Considered case-by-case

Refunds of unused credits are considered individually, within 14 days, for a technical issue: double charge, payment confirmed but credits not delivered, etc. Contact us with your **wallet address + transaction hash**.

3.4. Failed generations

If a generation fails, credits are automatically refunded to your in-app balance — no action needed.

3.5. How to request

Email [email protected] with your wallet address and transaction hash. We respond within a reasonable time (typically a few business days). Chargebacks do not apply (crypto payment).
